1. Acceptance of Terms

By accessing or using the website and services provided by SKAI Technology ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or engage our services.

These terms apply to all visitors, users, and clients who access our website or engage our professional services.

2. Services Description

SKAI Technology is a technology and design agency based in Phnom Penh, Cambodia. We provide professional services including but not limited to:

  • Web application development and design
  • Mobile application development
  • UI/UX design and branding
  • AI integration and automation solutions
  • Technical consulting and advisory
  • Ongoing maintenance and support

The specific scope, deliverables, timelines, and fees for any project are defined in individual proposals or contracts agreed upon between SKAI Technology and the client.

3. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, and code, is the property of SKAI Technology and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our website content without our express written permission.

For client projects, intellectual property ownership and licensing terms are defined in the individual project agreement. Unless otherwise specified in writing, upon full payment, the client receives ownership of the custom deliverables created specifically for their project. SKAI Technology retains the right to use general tools, frameworks, and methodologies developed during the engagement.

4. Confidentiality

We take confidentiality seriously. Any proprietary or sensitive information shared by clients in the course of our engagement will be treated as confidential and will not be disclosed to third parties without prior written consent, except where required by law.

This obligation of confidentiality applies to all project materials, business strategies, technical specifications, and any other information designated as confidential by the client. SKAI Technology expects the same confidentiality from clients regarding our proprietary processes and methodologies.

5. Payment Terms

Payment terms are specified in individual project proposals or contracts. Unless otherwise agreed in writing, the following general terms apply:

  • A deposit is required before project work commences.
  • Invoices are due within 15 days of issuance unless otherwise specified.
  • Late payments may incur a late fee as outlined in the project agreement.
  • SKAI Technology reserves the right to pause or suspend work on a project if payments are not received on time.
  • All fees are quoted in the currency specified in the project proposal (typically USD).

6. Limitation of Liability

To the fullest extent permitted by applicable law, SKAI Technology shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with our services or this website.

Our total liability for any claim arising from our services shall not exceed the total fees paid by the client for the specific project giving rise to the claim.

We make no warranties or representations, express or implied, regarding the results or outcomes of any project. While we strive for excellence in all our work, we cannot guarantee specific business outcomes.

7. Termination

Either party may terminate a project engagement in accordance with the terms set forth in the individual project agreement. In the absence of specific termination provisions:

  • Either party may terminate with 30 days' written notice.
  • The client shall pay for all work completed up to the date of termination.
  • SKAI Technology will deliver all completed work and materials upon receipt of outstanding payments.
  • Confidentiality obligations survive termination of any engagement.

We reserve the right to terminate access to our website or refuse service to anyone at our discretion.

8. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Kingdom of Cambodia. Any disputes arising from or in connection with these terms or our services shall be subject to the exclusive jurisdiction of the courts of the Kingdom of Cambodia.

Where international arbitration is preferred, both parties may agree in writing to resolve disputes through arbitration under mutually agreed rules and in a mutually agreed venue.
